What many don't realize is that some trusts contain provisions that dramatically change how assets are managed and distributed when the first spouse dies. These provisions were often designed to reduce estate taxes, protect children from prior relationships, preserve inheritances, or provide asset protection. For some families, these provisions are still exactly what they want. For others, they create complexity that may no longer be necessary.
The challenge is that after the first spouse dies, many of these provisions cannot be changed.
